Personal injury and clinical negligence disputes have a character that sets them apart from other civil disputes and it is important for the individual mediator to recognise and respect this. Our Medical Negligence Mediators have extensive experience. Our mediators also have the skills to relate to people from all walks of life and understand the complex and often highly charged emotional context of the same.

 Our mediators will explain  everything  to the participants about the mediation set up and process, answer questions  and  concerns and actively manage any issues arising during the mediation including the need for breaks. 

Clinical negligence/personal injury cases also often involve a large volume of complex medical or other expert evidence and it is important that the mediator is able to “speak the language” of these experts and distil and understand the evidence.  Further, our mediators have  a thorough understanding of the issue of damages in personal injury/clinical negligence claims. Damages in such claims are, in some respects, quite an exact science. They can also be very complicated. Claims often include, for example, technical arguments concerning multipliers,, Periodical Payment Orders (PPOs) and  funding arrangements. 

 Our mediators continually ensure that they keep up to date with the relevant case law and cost principles through training or their own learning.
